Privacy Policy

My Chauffeur is committed to protecting and respecting the privacy of users of its website and the platforms it manages.

With the entry into force on 25 May 2018, in all Member States of the European Union, of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation - ‘GDPR’), it has become necessary to implement and publicise this Personal Data Processing Policy, which underpins My Chauffeur's commitment to respect and be responsible for compliance with the rules on the protection of personal data it collects. This Policy thus establishes the basis on which any personal data obtained or provided by the respective owners is processed on this portal. The term ‘personal data’, as used in this Policy, refers to certain information such as name, email address, address, telephone number or any other information that can be used to identify its owner.

Consent

By registering on the website and/or providing any personal data, the data subject is freely giving their explicit consent for the personal data submitted to be processed for the purposes and under the terms described in this Policy and in accordance with the laws and regulations in force relating to personal data.

Processing of personal data

The processing of personal data consists of an operation or set of operations carried out on personal data or sets of personal data, whether or not by automated means, namely collection, recording, organisation, structuring, storage, adaptation, retrieval, consultation, use, disclosure, dissemination, comparison, interconnection, restriction, erasure or destruction. Some personal data must be supplied in order to provide the service and/or information in question. Turismo de Portugal will inform you of this obligation and if the required data is missing or incorrectly provided, Turismo de Portugal will not be able to provide the requested service and/or information. The provision of incorrect or inaccurate data is the sole responsibility of the respective data subject.

Rights of personal data subjects

Under the terms and for the purposes of Articles 13 to 22 of the GDPR, My Chauffeur hereby informs you that any data in its possession may be consulted, limited in its processing, rectified (for incorrectness, inaccuracy or incompleteness) by the respective data subject and, in the event that the processing is based on consent, the data subject also has the right to request the erasure of data whose processing does not fall within one of the lawful situations provided for in Article 6(1)(b) to (e) of the GDPR. My Chauffeur further informs you that, in cases where processing depends on consent, the data subject has the right to withdraw their consent at any time. Withdrawal of consent does not jeopardise the lawfulness of the processing carried out on the basis of the consent previously given. The data subject also has the right to object to the continued processing of their personal data, to be informed, on request, about the purposes of the processing, the categories of data involved, the identity of the recipients to whom they have been disclosed and the retention period of their personal data, as well as to receive the personal data concerning them that they have provided and send them to another controller (‘data portability’).

Subcontractors

My Chauffeur may use subcontractors for the maintenance, hosting and management of its computer systems and equipment, under the terms permitted by the legislation governing the processing of personal data. These entities are obliged to maintain confidentiality and guarantee security with regard to the data of users of the www.MyChauffeur.pt website, to which they have access for this purpose, and may not use this data for any other purpose, or for their own benefit, or relate it to other data they hold.

In any case, My Chauffeur remains responsible for the personal data made available to it.

Communication and transfer of personal data

Personal data may be disclosed to the courts and other competent authorities, in strict compliance with the provisions of the law, in particular when they prove necessary for the resolution of disputes and for activities relating to the protection of public security, the defence and security of the State and the prevention, investigation or detection of criminal offences.

Storage of personal data

The period of time for which personal data is stored and retained varies according to the purpose for which the information is processed. My Chauffeur only keeps personal data for as long as is necessary to achieve the purpose for which it was provided or to fulfil any contractual or legal obligations to which it is bound. Therefore, and whenever there is no specific legal requirement, the data will only be kept for the minimum period necessary to fulfil the purposes for which it was collected or subsequently processed, under the terms defined by law.

Complaints

Without prejudice to being able to submit complaints directly to My Chauffeur, through the contacts made available for this purpose, the data subject may complain directly to the National Data Protection Commission (CNPD), which is the Supervisory Authority in Portugal, using the contacts made available by this entity for this purpose.

Minors

Minors under the age of 16 must obtain authorisation from their parents or guardians before accessing or making personal data available on the site. It is the responsibility of their parents or legal guardians to identify the content and pages accessed by minors under the age of 16.

My Chauffeur reserves the right to make adjustments or changes to this Personal Data Processing Policy at any time, publishing such changes in the appropriate media.
